Yourcash Sender Terms & Conditions
These Terms apply each time you buy a Yourcash Voucher. Read them together with the Country Schedule for your purchase below. With Yourcash, you buy electronic money from Yoursafe. We create a Claim Link so that an eligible Receiver can claim the money into a Yoursafe account. Opening the link does not transfer the money. Any amount not validly transferred stays yours, including after a partial claim. The link has no fixed expiry date. We do not automatically return unclaimed money, but you can ask for it back at any time.
1. About this contract
1.1 “We”, “us” and “our” mean Yoursafe B.V., trading as Yoursafe and Yourcash. Our address is Danzigerkade 23D, 1013 AP Amsterdam, the Netherlands. Our Dutch company number is 34180575. We are an electronic money institution licensed and supervised by De Nederlandsche Bank (DNB), register number F0025. You can check our DNB public register entry F0025. Our contact details are in section 10.
1.2 “You” are the consumer who buys the Voucher. We call you the “Sender”. The person who claims it is the “Receiver”.
1.3 These Terms, your Country Schedule and the purchase details supplied before you pay form your contract. The Country Schedule adds rules for the offer in your country. It cannot take away rights that the law gives you.
1.4 The versions of these Terms and the Country Schedule supplied for your purchase apply to that purchase. A later version or a schedule for another country does not change your contract except as explained in section 10.2.
1.5 Each purchase is a separate contract for one Voucher. Buying a Voucher does not open a Yoursafe account for you, start a subscription or require you to buy another Voucher. The contract ends when no money remains on the Voucher because it has all been claimed or returned to you. If money is later restored to the Voucher under section 6.6, these Terms apply to it again. You can still complain or exercise rights relating to an earlier transfer after the contract has ended.
2. Buying a Voucher
2.1 You choose a Voucher amount between EUR 1 and EUR 150 and pay using an accepted payment method. Your Country Schedule may set a different range within that maximum. The Voucher holds electronic money, also called e-money. This means that we owe you the amount recorded on the Voucher. It does not earn interest.
2.2 Your contract starts when we approve your purchase and create the Voucher.
2.3 When you buy the Voucher, you ask us to issue the selected amount as e-money and to transfer any amount validly claimed under section 3 to the person who completes the claim process. We or your payment provider may require a security check for your payment. Section 5 explains your right to withdraw from the purchase.
2.4 Before you pay, we make these Terms, your Country Schedule and the required purchase information available to you. After you buy the Voucher, we email you a confirmation that you can keep. It shows our details, the date, payment status, Voucher reference, Voucher amount, any fee we charge, the currency and the total paid. It also explains how to contact us and ask for unclaimed money back. We provide the applicable contract versions in a form you can save and reproduce unchanged. You can ask us for a paper copy of these Terms and your Country Schedule.
2.5 Your Country Schedule sets out our charges. Before you pay, we show you the Voucher amount, any fee we charge, any tax we collect and the total amount to pay. Voucher purchases and claims are in euros. We do not convert currency when a Voucher is claimed. Your payment provider may charge its own fees or convert currency. These are not Yoursafe charges.
2.6 We may refuse a purchase before creating the Voucher, for example if the payment fails or a required check cannot be completed. If we do not create a Voucher, we do not keep your payment. We either do not collect it or arrange for it to be released or returned.
3. Sharing and claiming the Voucher
3.1 Anyone who has the Claim Link may be able to claim the money if they use the Yoursafe App and meet the eligibility requirements for the offer. Keep the link private and share it only with the intended Receiver. Do not post it online or sell it. Someone else who gets the link may claim the money first. Receiving or opening the link does not transfer or reserve the money.
3.2 When we approve a valid claim, we transfer the claimed amount to the Receiver’s account without delay. From that moment, that amount belongs to the Receiver. Section 3.3 explains what happens after a partial claim. Section 8 explains your rights if a transfer was not authorised or was carried out incorrectly.
3.3 A Receiver can claim all or part of the available Voucher balance. Limits that apply to the Receiver may also mean that only part can be claimed at one time. Each completed claim reduces the balance by the amount transferred. Any amount not claimed stays yours. It can be claimed later while the Claim Link can still be used, or you can ask us to return all or part of it under section 4.
3.4 We provide a record of each completed claim that you can save. It shows the Voucher and claim references, the amount, the date and, where appropriate, who received the money. It also shows any charge we apply and, where relevant, the remaining balance.
3.5 If the intended Receiver cannot complete a claim, any money not transferred stays yours. You can ask us to return it under section 4.
3.6 Contact us at once using the contact details in section 10 if the link is lost, stolen, exposed or sent to the wrong person. We can block further claims against money that is still yours. A completed claim cannot always be reversed. Section 8 explains your rights and responsibility for losses.
4. Getting your money back
4.1 You can ask us at any time to return all or part of the e-money that still belongs to you. This is called redemption. We redeem the e-money at its full value. Any separate fee is explained in section 4.5. There is no minimum amount. Redemption is not the same as a Receiver claiming the money.
4.2 Email accounthelp@yoursafe.com with your name and the Voucher reference, or other details that identify the purchase. We may ask for proof that the money belongs to you and for information required by law.
4.3 We normally return money using the same payment method you used to buy the Voucher. If that is not possible, we arrange another safe method after checking that you are entitled to the money. Once we have returned the whole remaining amount, no money remains on the Voucher and the Claim Link stops working. If we return only part, the rest stays yours. It can still be claimed, or you can ask us to return it. Money that is being returned can no longer be claimed.
4.4 Before returning money, we may need to perform identity, fraud, sanctions or other legal checks. We explain any delay unless the law or security reasons prevent this. You do not lose your right to the money just because we carry out these checks.
4.5 Any fee for returning your money is stated in your Country Schedule and disclosed before you buy.
4.6 Section 5 explains your separate right to withdraw from the purchase. Once a Receiver has validly claimed an amount, that amount belongs to the Receiver.
5. Withdrawing from the purchase
5.1 You may withdraw from this online purchase within 14 calendar days, without giving a reason or paying a penalty. The period starts when the contract is made or, if later, when you receive the terms and information required by law. Any longer period required by law still applies. Separately, you can ask for unclaimed money back at any time under section 4; that does not require withdrawal from the contract.
5.2 To withdraw, email a clear statement to accounthelp@yoursafe.com or write to Yoursafe B.V., Danzigerkade 23D, 1013 AP Amsterdam, the Netherlands. Include your name and enough purchase details for us to identify the Voucher. No special form is required. Your notice is on time if you send it before the withdrawal period ends. Keep a copy of what you sent.
5.3 Issuing the Voucher, opening the Claim Link or completing a claim does not by itself end your withdrawal right.
5.4 If you withdraw, we stop further claims against money that is still yours. We return any money we owe you following your withdrawal without delay and no later than 30 calendar days after receiving your notice. We normally use the same payment method you used to buy the Voucher. If that is not possible, we arrange another safe method under section 4.3. We do not charge a cancellation fee or deduct a fee for services already provided.
5.5 Withdrawing does not automatically reverse a valid claim. Money validly claimed by a Receiver belongs to that Receiver. This does not limit any refund rights you have following withdrawal.
6. The Claim Link and problems
6.1 The Claim Link can be used from the time you buy the Voucher. It has no fixed expiry date.
6.2 The link stops working when no money remains on the Voucher or when we block it. Blocking the link does not by itself affect your right to money that is still yours.
6.3 Unclaimed money remains yours until it is claimed or returned. You can ask for it back at any time by emailing accounthelp@yoursafe.com. Section 4 explains the process. If no money has been claimed or returned for 12 months, we may end the contract. We give you at least two months’ notice by email. The notice states when we plan to return the remaining money and end the contract. We return the money as explained in section 4. The contract ends once all remaining money has been returned.
6.4 Tell us if you do not receive the purchase confirmation or Claim Link. If we created a Voucher, we help you access it or return the money under section 4. If we received your payment but did not create a Voucher, we return the amount we received using the same payment method. If the payment was only authorised, we release it.
6.5 If a claim does not complete, any money not transferred stays on the Voucher. The Receiver can try again if the link still works and the problem can be resolved.
6.6 If we reverse a claim because of a mistake, a duplicate transfer or fraud, and recover the money, we restore that amount to the Voucher or return it to you after the necessary checks. If the law requires us to refund you or correct a transfer, we do so within the applicable deadline, even if we have not recovered the money.
6.7 We may block a link or pause a claim while we investigate suspected fraud or misuse, or where the law requires us to do so. We explain what has happened unless the law or security reasons prevent us from doing so.
7. Using Yourcash
7.1 You must meet the age, country and other eligibility requirements in your Country Schedule. A Receiver must meet the eligibility requirements that apply when they claim.
7.2 We may ask you or the Receiver for information or carry out checks where required by law or to prevent fraud or financial crime. We may refuse a purchase or pause a claim or redemption while necessary checks are completed.
7.3 Use Yourcash only to send your own money to someone you know for a lawful, private and non-commercial purpose. Do not sell or trade a Claim Link. Do not use Yourcash to pay a seller for goods or services, to gamble or to move money for someone else. Do not send money because an unknown support agent, investor or online contact tells you to.
7.4 Give us accurate information and a working email address. If you add a message for the Receiver, it must be lawful and must not threaten, discriminate against or infringe another person’s rights. We may remove a message that breaks this rule.
8. If something goes wrong
8.1 Contact us promptly if there is a problem with a purchase or claim. We check what happened and where the money is. You keep any rights you have against your card issuer, including where the card used to buy the Voucher was stolen or misused.
8.2 Under section 2.3, you ask us to transfer money to the person who validly completes the claim process. A claim completed through that process before you ask us to block the Claim Link may be covered by your instruction. However, use of the Claim Link alone does not prove that you authorised a disputed transfer. If you tell us that you did not authorise a transfer, we investigate what happened. Sections 8.3 to 8.6 explain your rights and our responsibilities.
8.3 Tell us promptly if someone gets the Claim Link without your permission, for example by accessing your email. We investigate what happened and whether the transfer was authorised. If you acted fraudulently or were grossly negligent in protecting the Claim Link, you may have to bear the loss, within the limits the law sets.
8.4 We are responsible for problems caused by us or a company acting for us. This includes exposing the Claim Link, allowing a claim outside the agreed process or failing to act on a timely blocking request.
8.5 Tell us without delay if you discover a transfer you did not authorise or that was carried out incorrectly. Where the 13-month legal deadline applies, you must normally report it within 13 months of the date the amount was taken from the Voucher. This deadline does not apply if we failed to give you the required information about the transfer.
8.6 If the law requires us to refund an unauthorised transfer, we do so without delay and no later than the end of the next business day after we become aware of it. We may delay the refund only where the law allows this because of suspected fraud. If the problem concerns the card payment used to buy the Voucher, contact your card issuer as well.
8.7 If your card issuer refunds the purchase and this leaves you with money you were not entitled to keep, we may recover the resulting amount from you. A card dispute does not by itself reverse a valid claim or take money from the Receiver. We do not recover the same amount twice.
8.8 We do not limit any responsibility that the law says we must accept. We are not responsible for resolving personal disputes between you and the Receiver. We are also not responsible for abnormal and unforeseeable events outside our control whose effects could not have been avoided despite all efforts to the contrary.
9. Personal data and protection of your money
9.1 The Yourcash Privacy Notice supplements the Yoursafe Privacy Policy. Together, they explain how we use your personal data and how you can exercise your privacy rights.
9.2 If you give us the Receiver’s email address, only use an address that you are allowed to share with us. We use it to send the Claim Link and handle the claim, as explained in our privacy information. Our first message to the Receiver explains that you gave us the address and how we use it.
9.3 We protect the money represented by the Voucher for as long as we hold it, in accordance with the rules that apply to electronic money institutions. E-money is not a bank deposit and is not covered by a deposit guarantee scheme.
10. Updates, complaints, law and contact
10.1 We may change these Terms or a Country Schedule for future purchases. A change does not affect an earlier purchase unless section 10.2 applies.
10.2 We only change the terms of an existing Voucher where the law requires us to do so. We tell you about the change where required.
10.3 To complain, email accounthelp@yoursafe.com, use the form on the Yoursafe Contact Page or write to us at the address in section 10.5. Tell us which purchase or claim the complaint is about and what went wrong. We give you our final response within 15 business days after receiving your complaint, on paper or in another agreed form you can keep. If exceptional circumstances outside our control prevent this, we explain the delay within those 15 business days and tell you the date by which you will receive our final response. We provide it no later than 35 business days after receiving your complaint.
If your complaint is not resolved, you may take it to Klachteninstituut Financiële Dienstverlening (Kifid), the Dutch financial-services complaints institute, if it falls within Kifid’s rules. Procedures, time limits and English forms are at Kifid complaint instructions. Contact: P.O. Box 93257, 2509 AG The Hague, the Netherlands; +31 70 333 8999. For help finding a body for a cross-border financial complaint, contact a FIN-NET member. Your Country Schedule lists any additional national routes.
10.4 The laws of the Netherlands apply to our contract and these Terms. You keep any consumer rights that apply to you under the law of your home country. You may use any court available to you under consumer law, including a court where you live.
Yoursafe is licensed in the Netherlands by De Nederlandsche Bank. You can report regulatory concerns through the DNB reporting page. A supervisor does not settle your private dispute or award compensation.
10.5 Contact: Yoursafe B.V. (Yourcash), Danzigerkade 23D, 1013 AP Amsterdam, the Netherlands; accounthelp@yoursafe.com; +31 20 531 5700; Yoursafe Contact Page. You can ask us to explain Yourcash before you buy. If we help you through an automated service, you can ask for a person instead, also after purchase where needed. Your Country Schedule states the languages used for documents and communication.
